Panel Title: Rethinking industry-Government collaboration in the wake of a cyber incident – and how to harness the power of togetherness while navigating legal risks   


Industry-provided threat intelligence is crucial for enhancing Australia's cyber offensive capabilities and creating a comprehensive understanding of cyber threats. Further, sharing timely incident details enables the Government to better support organisations during cyber events with consequence management in mind. 

Yet industry is increasingly concerned about the risks associated with sharing confidential information and in what order, given the cascading nature of breach response and evolving findings as investigations proceed. There are also concerns that any sensitive information may be used against victim companies and their directors in later regulatory investigations or third-party litigation. Further, there are multiple stakeholder interests to consider including market disclosures to shareholders, the reputation of key personnel, directors, CISOs, and the company itself. 

The Australian government is currently considering proposed legislative reforms to address these matters and to provide solutions for information sharing in the wake of an incident. This follows a public consultation period in which the Department of Home Affairs received over 100 submissions from various industry and government organisations, including AISA. 

Moderated by Stefanie Luhrs (Partner, Clyde & Co), come and hear from panellists Valeska Bloch (Partner, Allens), Peter Jones (Partner, HSF), and Richard Martin (Director Communications, Cyber, Clyde & Co) as they provide industry perspectives into:

  • the proposed legislative reforms to get industry more comfortable with information sharing and closer collaboration with the Government; 
  • the proposed no-fault, no-liability ransomware reporting obligation; and
  • what the right balance looks like weighing market disclosure and third-party litigation risks.

Panelists:

Valeska Bloch is a Partner at Allens and is a leading cybersecurity, technology and data practitioner whose practice covers the spectrum of transactional, regulatory, governance, risk management and incident response work. She has particular expertise in highly-regulated critical infrastructure and data-intensive sectors, including financial services, technology, retail, telecommunications, resources, healthcare and government.


Richard Martin is Director of Communications within Clyde & Co’s incident response practice. He leads a crisis communications team which specialises in stabilising and supporting clients through each stage of their response - through developing crisis communications playbooks, strategic advisory strategy, government relations and notification programs.  


Peter Jones
is a market leading telecoms lawyer specialising in complex technology and information transactions and Partner at Herbert Smith Freehills. Peter advises clients across a broad range of sectors, including financial services, telecommunications, government, consumer, healthcare, infrastructure and energy.

His work often requires navigating regulatory requirements, in particular those arising from changes to business processes, the impact of information regulation such as privacy and cyber security/resilience and the effects of sector-specific regulatory requirements which apply to information processing and technology deployment.

Moderator:

Stefanie Luhrs is a Partner at Clyde & Co specialising in cyber incident response, data protection, IT liability matters and data breach regulatory investigations.
She regularly works on domestic and international cyber claims involving complex cyber incidents, regulatory issues, mandatory notification laws, misdirected funds and recovery actions against third parties.
